PREAMBULE
The site www.shanti-spirit.com is a site of the French company SHANTI SPIRIT.
Any order for a product listed on the site www.shanti-spirit.com requires prior consultation of these Conditions of Sale, and their acceptance.

SHANTI SPIRIT agrees to accept orders under the following terms of these Conditions of Sale.
The customer chooses, using the electronic catalog, the products it wishes to acquire and transmit the order to SHANTI SPIRIT from an order form available on the site and confirm as instructed.
In case of out of stock, SHANTI SPIRIT agrees to inform the customer by E mail :
- Either to cancel the order, or products not available and receive a credit for the amount,
- Or to postpone the delivery of the order, effective from the day of availability.
By confirming an order, the customer accepts these Conditions of Sale. This confirmation, and all data recorded, constitute proof of these transactions.
ARTICLE 3 : PRICE SALE
Product prices charged are those shown on the electronic catalog at the time of order. The sale prices are in Euros, and are marked as 'Net Price'. ARTICLE 4 : PAYMENT
In order to secure outstanding check or credit payments, SHANTI SPIRIT reserves the right to make any necessary legal actions. SHANTI SPIRIT may refuse to make a delivery or fill an order to a customer who does not fulfil settlement, or a previous order or with which a payment dispute is ongoing. Until actual receipt of all sums due to SHANTI SPIRIT ; SHANTI SPIRIT remains sole owner of the delivered products, and maintains the right to the products recovery by all legal means at its disposal.
ARTICLE 5 : DELIVERY
The products ordered are delivered by "poste" after receipt of payment to the address specified by the customer within 3 to 4 days to mainland France. SHANTI SPIRIT reserves the right to use any other means of delivery. Delivery times may vary in cases of difficulty in delivery, out of stock, or holiday periods, which will be reported by email, or announced on the website www.shanti-spirit.com. Sundays and Holidays are not included as working days.
ARTICLE 6 : NOT AVAILABLE
SHANTI SPIRIT will strive to meet customer's requests and orders for these products under these conditions and deadlines. However, SHANTI SPIRIT is not obliged to accept any order, and can not be held liable to customers for late delivery or non availability of temporary or permanent products.
ARTICLE 7 : FORCE MAJEURE
Responsibility for SHANTI SPIRIT can not be held liable in cases of force majeure such as strikes, fires, natural disasters or other.
ARTICLE 8 : RESERVES
The customer should make sure the good condition of items upon delivery. In cases of damage it is up to the client to register their declaration with regards the delivery, and notify SHANTI SPIRIT by written or printed letter, showing the receipt, within a maximum period of 48 hours at the following address: SHANTI SPIRIT "les choseaux" 73450 Valloire (France) .
ARTICLE 9 : RIGHT OF RETURN
According to the legislation governing the sale by mail-order online (Article L 121-16 of the French Consumer Code), the customer has, within 7 days after delivery of his order, a right of return , exchange, or refund of the damaged product(s), excluding shipping costs. The individual item(s) are to be returned in new condition, undamaged and in its original packaging.
ARTICLE 10: DISPUTES
In case of dispute, the parties of granting jurisdiction to the Tribunal de Commerce de Montbizot (Sarthe France).
ARTICLE 11 : FREEDOM OF INFORMATION
The client has a right to access, modify and delete data which concern them (art.34 of the french law "Freedom and information").

ARTICLE 12 : ACCEPTANCE OF THE BUYER
The act of purchase entails the acceptance of these Conditions of Sale as well as rates by the buyer who declares and acknowledges having a read the above.
SHANTI SPIRIT sell all products in accord with the requirments of article L 111-1 of the French Consumer Code, which allows the buyer to gain description the characteristics of product before the final order taking. Product characteristics are continuously improved nd are subject to change without notice.
